Timing out victory in clash of might

I\'ve been on both ends of this one. Someone who is ranked, say, 10 in Clash of Might challenges someone who is ranked 8. The battle ends with no one being defeated, but the challenger gets the victory and moves up from 10th to 8th. That doesn\'t seem right, especially in Clash of Might. If it is not a clear victory, why and how does the challenger get to move up in rank?
